Terms of use

1. Publisher

The Aquatracking app and the aquatracking.live website are published by Alain Simac, AE, 293 route du tunnel 73370 Le bourget du lac. Contact: alain.simac@gmail.com.

2. Purpose

Aquatracking records an open-water swim crossing using the iPhone’s GPS (track, distance, time, pace, heading), compares it to a planned route and, optionally, shares the swimmer’s live position with third parties through a public link.

3. Account

Personal tracking requires no account. Shareable mode, credits and online archiving require an account (name, email, password). Users are responsible for keeping their credentials confidential. The account can be deleted at any time from the app (Account tab); all associated data is then erased.

4. Credits and subscription

Shareable mode uses one credit per crossing, unless an “Unlimited” subscription is active. Credits and subscriptions are purchased through Apple’s App Store, under Apple’s terms (billing, cancellation, refunds). Credits do not expire and are not refundable once used. The subscription renews automatically unless cancelled in the Apple ID settings at least 24 hours before the renewal date.

5. Safety and liability

Aquatracking is an information tool, not a safety or rescue device. GPS accuracy varies with conditions; live transmission depends on network coverage and phone battery. The publisher cannot be held liable for a transmission failure, a measurement inaccuracy or any harm occurring during a crossing. Open-water swimming carries risks: users swim at their own risk, in compliance with local regulations and with appropriate support.

6. Public tracking link

The link aquatracking.live/t/CODE is accessible to anyone who has it, without authentication. Users freely choose whom they share it with. The link shows the swimmer’s position, track, distance, time and first name during and after the crossing. Users may also, at each start, make their crossing visible on the public page aquatracking.live/live; this option is off by default.

7. Intellectual property

The app, website, brand and reference routes belong to the publisher. Crossing data recorded by users remains their property; they grant the publisher a hosting licence limited to operating the service.

8. Changes and termination

The publisher may change the service and these terms; the applicable version is the one published at this address. In case of serious breach, the publisher may suspend an account.

9. Governing law

These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of Lyon.
